QUESTION:
Another question: we purchased some real-estate property with my solo 401k; how should it be
titled? I suspect simply in the name of the solo 401k. I wasn't
sure if it could or should be in our name.
Thanks again, Tina C. from Colorado
ANSWER: When using 401k to invest in real
estate, it must be titled in the name of the 401k. Therefore, if your solo 401(k) invested in real estate,
meaning funds from the solo 401k bank account were used to make the real estate purchase, the deed must be
recorded in the name of the Solo 401k plan instead of your personal name. If
registered in your name, it would be considered a taxable distribution if not
promptly corrected.
